Terms of Service

The short version. WaCha.Net is a free watch-party service. You paste a link to a video that is already published somewhere else, we create a room, and the people in that room watch it in sync and chat. We do not host video and we do not control what other people put in a room. You are responsible for the links you load and the things you type. Be over 18, follow the law, do not harass people, and do not use the Service to distribute material you have no right to distribute.

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and US Support LLC ("we", "us", or "our"), a Nevada limited liability company, covering your use of WaCha.Net at https://WaCha.Net and everything served from it (the "Service").

By visiting the Service, creating or joining a room, sending a chat message, or registering an account, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, do not use the Service. You agree to these Terms whether or not you register; starting a room as a guest counts.

2. What the Service is

WaCha.Net lets people watch the same video at the same time and talk about it. In practice that means:

  • You paste a link to a video that is already publicly available on a platform such as YouTube, Rumble, BitChute, or Spotify.
  • We create a room, give it a link or short code, and embed that platform's own player in it.
  • Play, pause, and seek are synchronised across everyone in the room so you stay together.
  • The room has a text chat and a list of who is present.
  • Rooms may be public and listed in the channel guide, unlisted, private, or protected by a room password, at the room creator's choice.

We are a synchronisation and chat layer, not a video host. No video files are uploaded to, stored on, transcoded by, or served from our servers. The video you see is delivered by the third-party platform directly to your browser, subject to that platform's own rules.

3. A free service, provided as-is

The Service is provided free of charge. There is no subscription, no paywall, and we do not take payment from users. Because it is free and provided as a convenience, we make no commitment as to uptime, performance, retention of your rooms or chat history, or continued availability of any feature. See Sections 12, 14, and 15.

4. Accounts, credentials, and guests

You can use the Service without an account. When you do, we issue you a temporary guest identity with a random name and avatar. Guest identities that sit idle for 24 hours are deleted automatically, and anything tied to them may go with them.

If you register an account, the following apply:

  • You must give accurate registration details and keep them accurate.
  • You do not choose your own password. We generate a strong password and a recovery key at registration, display them once, and offer them to you as a downloadable file. We store only one-way hashes of both.
  • It is your responsibility to save that file somewhere safe. If you lose both your password and your recovery key, we cannot recover the account. We do not hold a readable copy and there is no support path around it.
  • You are responsible for everything done through your account. Tell us promptly if you believe it has been compromised.
  • Do not share your credentials, sell or transfer your account, or register accounts on someone else's behalf without their permission.
  • One person, one account. Do not register accounts in bulk or by automated means.

5. Age requirement

You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, to register an account or to use the Service. The Service is not directed to children, and we do not knowingly permit anyone under 13 to use it or knowingly collect their information. By using the Service you represent that you meet this requirement. We may suspend or remove any account we reasonably believe does not.

6. Acceptable use

Rooms are shared spaces with real people in them. You agree that you will not use the Service to:

  • Break the law, or encourage or facilitate anyone else in doing so.
  • Harass, threaten, stalk, bully, defame, or incite violence or hatred against any person or group.
  • Load, post, or link to content that is unlawful; that sexually exploits or endangers minors in any way; that depicts non-consensual sexual conduct; or that promotes terrorism or mass violence.
  • Load, post, or link to material you do not have the right to share, including material that infringes someone else's copyright, trademark, or other rights.
  • Circumvent, strip, or interfere with the access controls, geographic restrictions, digital rights management, or terms of any third-party platform whose player is embedded on the Service.
  • Impersonate another person, or misrepresent your affiliation with any person or organisation.
  • Post other people's private information, such as addresses, phone numbers, identity documents, or private communications, without their consent.
  • Send spam, chain messages, unsolicited advertising, pyramid or referral schemes, malware, or phishing links.
  • Flood chat, defeat or evade rate limits, or otherwise degrade the experience for other users.
  • Scrape, crawl, harvest, or bulk-download data from the Service; access it through automated clients or bots; or circumvent our CSRF protection, captcha, or other security measures.
  • Probe, scan, or test the vulnerability of our systems, or attempt to gain unauthorised access to any account, room, server, or data.
  • Interfere with the operation of the Service, including through denial-of-service attacks, injection attempts, or excessive automated requests.
  • Resell, sublicense, or commercially exploit the Service or access to it without our written permission.

We do not pre-screen rooms or chat. We are not obliged to monitor them, but we may review and remove content, rooms, or accounts at our discretion when we become aware of a problem.

7. Your content and rooms

"Your Content" means the chat messages you send, the room names, codes, and descriptions you set, the avatar and display name you choose, and the links you load into a room.

You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to store, host, reproduce, transmit, and display Your Content to the extent needed to operate and provide the Service: for example, to deliver your chat message to the other people in the room, to show your room's name in the public channel guide, and to keep the room's history readable. This licence exists so the Service can function; it ends when the content is deleted from our systems, other than for copies retained in routine backups or as the law requires.

You represent that you have the rights necessary to grant that licence, and that Your Content does not infringe anyone's rights or break any law.

Be aware of how public a room is: anyone in a room can read everything sent in it, and a public listed room appears in the channel guide with its name and current video visible to any visitor. Room passwords limit who can join; they do not make a room confidential from the people inside it. Chat history remains readable to people who join a room later. We do not guarantee that any room or message will be retained for any particular period, and rooms, messages, and guest identities may be deleted as part of routine cleanup.

8. Third-party video and links

The Service embeds players operated by third parties and displays links that users post. We do not select, endorse, verify, control, or take responsibility for that material.

  • Your use of an embedded player is also subject to that platform's terms of service and privacy policy.
  • Availability of any video is entirely up to the platform hosting it. Videos may be removed, made private, geo-blocked, or made non-embeddable at any time, and the room will stop working for that video.
  • Content you encounter through the Service may be inaccurate, offensive, or unsuitable. You view it at your own discretion and risk.
  • If a room is playing something you believe violates these Terms, please report it to us.

9. Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. Because we do not host video files, a complaint about the content of a video is normally a matter for the platform actually hosting it, and the fastest remedy is to file with that platform, since removing it there removes it everywhere it is embedded, here included.

Where material stored on our systems, such as a chat message, room name, or link, infringes your copyright, send us a notice through ussupportllc.com including:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you say is infringed.
  • Identification of the material you want removed, with enough detail for us to locate it, such as a room link or URL.
  • Your contact details: address, telephone number, and email.
  • A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorised to act on the owner's behalf.

We will remove or disable access to material we determine to be infringing, and we may terminate the accounts of users who repeatedly infringe. If you believe your material was removed in error, you may send a counter-notice through the same channel. Knowingly making a material misrepresentation in either direction may expose you to liability.

10. Our intellectual property

The WaCha.Net name, logo, interface, design, and underlying software are owned by us or our licensors and are protected by intellectual property law. We grant you a limited, personal, revocable, non-transferable licence to use the Service as intended. You may not copy, modify, reverse engineer, create derivative works from, or redistribute any part of the Service except as the law allows notwithstanding this restriction.

11. Privacy

Our Privacy Policy explains what information the Service handles and why, and forms part of these Terms. Please read it. In short: we store what is needed to run rooms and chat, we do not sell your data, and the embedded video platforms have their own privacy practices we do not control.

12. Availability and changes to the Service

We may change, suspend, limit, or discontinue the Service or any part of it at any time, with or without notice. Features may be added or removed. Rooms, chat history, guest identities, and inactive accounts may be cleaned up. We will not be liable to you for any modification, suspension, or discontinuation of the Service, or for any loss of rooms or messages.

13. Suspension and termination

You may stop using the Service at any time, and you can ask us to delete your account by contacting us.

We may suspend or terminate your access, remove your rooms or content, or delete your account, with or without notice, if we reasonably believe you have breached these Terms, if it is necessary to protect other users or the Service, or if required by law. Sections that by their nature should survive termination, including Sections 7, 9, 10, 14, 15, 16, 18, and 20, continue to apply afterwards.

14. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that video synchronisation will be accurate; that any video, room, or message will remain available; or that any content accessed through the Service is lawful, accurate, or suitable for you. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, US SUPPORT LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR ROOMS AND CHAT HISTORY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS INCLUDES ANY CLAIM ARISING FROM THIRD-PARTY CONTENT, EMBEDDED VIDEO, LINKS POSTED BY OTHER USERS, OR THE CONDUCT OF ANY OTHER USER, WHETHER ONLINE OR OFFLINE.

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless US Support LLC and its officers, members, employees, agents, and affiliates from any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, the links or videos you load into a room, your breach of these Terms, or your violation of any law or the rights of a third party.

17. International users

We operate the Service from the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for complying with the laws of your own jurisdiction, including any restrictions on the content you watch or share. We make no representation that the Service or any content available through it is appropriate or available in any particular location.

18. Governing law and disputes

These Terms are governed by the laws of the State of Nevada and applicable federal law of the United States, without regard to conflict-of-law rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. There are two exceptions: either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information, and the mandatory consumer law of your country of residence may give you the right to bring proceedings locally.

Any claim you have relating to the Service must be brought within one year after it arises, to the extent the law permits such a limit.

19. Changes to these terms

We may revise these Terms from time to time. When we do, we will update the "last updated" date above, and we will make a reasonable effort to give notice on the Site for material changes. Continuing to use the Service after the revised Terms take effect means you accept them. If you do not accept them, stop using the Service.

20. General terms

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any earlier agreements or understandings on that subject.
  • Severability. If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest of the Terms remain in force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or in connection with a transfer of the Service.
  • No agency. These Terms do not create any partnership, employment, joint venture, or agency relationship between you and us.
  • Force majeure. We are not liable for failures caused by events beyond our reasonable control.
